Il sistema sanitario della regione Lombardia, tra “sussidiarietà competitiva” e “sussidiarietà partecipativa”

The healthcare system of the Lombardy Region features specific characteristics, even after recent reforms. Among these specificities, the main one consists in the liberalization of private health facilities. Liberalization has prompted an intense debate and numerous doubts in terms of compliance with the Constitution. National reforms, anyway, urge us to rethink these concerns. At the same time, the poor sensitivity of the regional legislator towards participatory institutions deserves greater attention: it confirms a conception of the healthcare system under which pluralism is expressed only in the freedom between public and private health facilities.

Tra queste specificità la principale consiste nella liberalizzazione degli accreditamenti delle strutture private. La liberalizzazione ha sollecitato un intenso dibattito e numerose perplessità anche sul piano della conformità a Costituzione. Ma le riforme nazionali inducono a rimeditare sulla consistenza di tali preoccupazioni.
