VESSEL & PLEASURE CRAFT AND CIVIL LIABILITY INSURANCE ABSTRACT Recreational navigation is regulated by Legislative Decree 18 July 2005 No. 171, which contains the so called «codice della nautica da diporto » (Code of Yachting). As for «recreational navigation unit» (defined by art. 3, lett. a - d), art. 40 of Italian Code of Yachting provides that the liability arising from their circulation is regulated by art. 2054 of the Civil Code. The removable engine is the premise of compulsory insurance of civil liability. Thus, art. 41 of Legislative Decree 18 July 2005 No. 171 confirms what is already foreseen by art. 48 of the (previously in force) law 11 February 1971 No. 50. The provisions of the law 24 December 1969 No. 990 on «compulsory insurance of motor vehicles and boats» (repealed and replaced by Legislative Decree 7 September 2005 No. 209, so called «Code of Private Insurances») apply to the «crafts», but not including those rowing and sailing without engine. As to third party liability, the reference under art. 40 of the Legislative Decree 18 July 2005 No. 171 to a provision of the civil code (art. 2054 c.c. «circulation of vehicles») does not distort the nature of civil liability insurance for damages arising from the use of «pleasure crafts». This insurance covers «the risks of navigation», with the result that it is applicable, as a connection norm, art. 1 of the code of navigation. Even the damage caused to third parties for by water displacement without material collision (art. 488, code of navigation) must be compensated, as part of the civil liability arising from the use of pleasure crafts (art. 40, Legislative Decree 18 July 2005 No. 171). Concerning insurance in contracts of rental and lease, in the art. 45 and 48, the Code of Yachting provides for the obligation of insurance upon the charter and the lessor, respectively. Injuries covered by the insurance of the charterer include not only those due to the fault of the charterer and the crew, but also those caused by accident or negligence of the victim. In this sense, the Code of Yachting extends the scope of the original insurance obligation.

La nautica da diporto è disciplinata dal d. lgs 18 luglio 2005 n. 171, recante il c.d. «codice della nautica da diporto ». Quanto alle «unità da diporto» (definite dall’art. 3, lett. a - d), l’art. 40 del codice del diporto dispone che la responsabilità derivante dallo loro circolazione «è regolata dall’art. 2054 del codice civile». Il motore amovibile è il referente dell’assicurazione obbligatoria della responsabilità civile. In tal modo, l’art. 41 del codice del diporto conferma quanto già previsto dall’art 48 della previgente legge 11 febbraio 1971 n. 50. Le disposizioni della legge 24 dicembre 1969 n. 990 sulla «assicurazione obbligatoria dei veicoli a motore e dei natanti» (abrogata e sostituita dal d. lgs. 7 settembre 2005 n. 209, c.d. «codice delle assicurazioni private») si applicano alle «unità da diporto», escluse quelle a remi e a vela prive di motore. Quanto alla responsabilità civile verso terzi, il rinvio (art. 40 del «codice della nautica da diporto» ) ad una norma del codice civile (art. 2054 c.c. «circolazione di veicoli») non snatura l’assicurazione della responsabilità civile per i danni derivanti dalla circolazione dei «natanti» (rectius «unità da diporto»). Questa assicurazione ricade fra le «assicurazioni contro i rischi della navigazione», con la conseguenza che è applicabile, quale norma di raccordo, l’art. 1 c. nav. Anche il danno arrecato a terzi per «spostamento d’acqua senza collisione materiale » (art. 488 c. nav.) deve essere risarcito, poiché rientra nella responsabilità civile derivante dalla circolazione delle unità da diporto (ex art. 40 c. naut. dip.). Quanto all’assicurazione nei contratti di noleggio e di locazione, l’art. 48 del codice, in tema di obblighi del noleggiante, prevede, come per la locazione, ex art. 45, l’obbligo assicurativo. Per la copertura del «rischio infortuni», questi possono anche non dipendere da colpa del noleggiatore o dell’equipaggio, come avviene nel danno causato da caso fortuito o da colpa dello stesso infortunato. In questo senso il legislatore del codice della nautica da diporto ha previsto una tutela che supera l’originario contenuto dell’obbligo assicurativo.
