This scientific publication analyses the issue of the use of genetic data for employment purposes, beginning by the recognition of the fields of application (three main sectors: labour relations, labour market and social security) and of the “threats” and “opportunities” of that use. The article also analyses international, EU and national sources concerning the processing of genetic data in the employment relationship. Then it highlights the lack in Italy of a specific statutory regulation, since just a “General Authorization for the Processing of Genetic Data” was passed by the “Garante per la protezione dei dati personali” (i.e. the Italian supervisory Authority of data protection). Moreover, the article verifies the applicability to the processing of genetic data of the principles and rules of Italian labour law regarding the control of workers’ health and of the general legislation on the protection of personal data (Legislative Decree n. 196/2003). Finally, it points out the necessity of a proper statutory regulation of the processing of genetic data for employment purposes.
Il saggio affronta il tema del trattamento dei dati genetici dei lavoratori, privo di disciplina legislativa in Italia, partendo dalla individuazione dei campi di utilizzo di tali informazioni (rapporto di lavoro, mercato del lavoro e previdenza sociale) e di rischi ed opportunità di questo. Esso ricostruisce, poi, il panorama delle fonti internazionali, dell’Unione europea e nazionali, verificando l’applicabilità a detto trattamento dei principi e delle regole posti, dall’ordinamento del lavoro italiano, per il controllo sullo stato di salute del lavoratore, e delle ulteriori garanzie derivanti dalla normativa generale sulla protezione dei dati personali. Delinea, infine, i possibili contenuti di una futura regolamentazione della materia.
