“Il volontariato nel ‘sistema’ delle relazioni gratuite. Profili ricostruttivi e regole di tutela”

In recent years the crisis of the welfare state has given strong impetus to the cd third sector and, especially, in voluntary work. Starting from this reality and the phenomenal view of the normative data, the research explores the problem of the legal activities of the case-and its unique place in the "system" of free reports, comparing the different reconstructive options gained in forming and evaluating doctrinal the impact on practical grounds the necessity of protection of the interests involved. In this perspective, the proposed solution - adherence to the model of management of the affairs of others, properly "read back" into its structural and functional profiles - seems to be the best position to balance the (conflicting) demands the protection of the volunteer and the beneficiary provision of solidarity.

In anni recenti la crisi del welfare state ha dato forte impulso alle iniziative del c.d. third sector e, in special modo, alle attività di volontariato. Muovendo da tale realtà fenomenica e dalla considerazione dei dati normativi, la ricerca approfondisce il problema della qualificazione giuridica della fattispecie-attività e della sua peculiare collocazione nel “sistema” delle relazioni gratuite, ponendo a confronto le diverse opzioni ricostruttive maturate nel formante dottrinale e valutandone l’impatto sul terreno pratico delle esigenze di tutela degli interessi coinvolti. In questa prospettiva, la soluzione proposta - l’adesione al modello della gestione d’affari altrui, opportunamente “riletta” nei suoi profili strutturali e funzionali - appare come la più idonea a contemperare le (contrapposte) istanze di tutela del volontario e del beneficiario della prestazione solidaristica.
