Tutori magistratuali ed esonero dalla satisdatio in Gaio e in Giustiniano

The Gai draft (Gai 1.199-200) and the Justinian one (I. 1.24 pr.), in the same passage of the institutional manual regarding the obligation to satisdare to tutors and curators and its relative exemptions, can be compared. The differences between the two drafts, especially relating to the last part of the passage, seem to reveal a different discipline between the classic Roman and Justinian systems, which would result in them being hard to understand, while making perfect sense in the eyes of the juridical language’s change. In effect, the exemplifying value of Gai’s list, referring to the categories exonerated from the obligation to satisdare, justifies the missing reference expressed in the magistrate tutors category. A reference that instead appears in the passage of the imperial manual which is inevitably characterised by the exhaustive nature of the Justinian style.

Si mettono a confronto la redazione gaiana (Gai 1.199-200) e quella giustinianea (I. 1.24 pr.) dello stesso passo dei manuali istituzionali riguardante l’obbligo di satisdare per tutori e curatori e i relativi esoneri. Le differenze tra le due redazioni, relative soprattutto all’ultima parte del brano, sembrerebbero far trasparire una differenza di disciplina tra il regime classico e quello giustinianeo che risulterebbe, però, difficilmente comprensibile, mentre si spiegano perfettamente nell’ottica del cambiamento della forma del linguaggio giuridico. Infatti la valenza esemplificativa dell’elencazione gaiana, riguardante le categorie esonerate dall’obbligo di satisdare, giustifica il mancato riferimento espresso a quella dei tutori magistratuali, riferimento che, invece, appare nel passaggio del manuale imperiale, caratterizzato inevitabilmente dall’esaustività propria dello stile giustinianeo.
