The present contribution deals with the recent initiatives of the European institutions in ensuring the respect of the rule of law and the common values set forth in Article 2 TEU. It highlights the different scope of procedure under Article 7(1) of the Treaty on European Union with the infringement procedure under Article 258 TFEU. Then it examines the new EU Framework to strengthen the Rule of Law and the Commission Rule of Law Recommendation that substantiates its grave concerns on the planned reform of the judiciary in Poland.

Abstract
