This paper examines the elements that qualify transport as simple material operation and as contract. Thereby, materials activities that do not incorporate the concept of transport in the technical senseare here excluded. Then, this writing analyzes the figure in an historical perspective and illustrates the essential characteristics of the contract: the obligations of the carrier in its various applications and the duties of the counterparty. In this frame, this work distinguishes transport from akin contracts, from atypical figures and from other cases in which transport is instrumental to other contracts.
