The figure of the damage caused by loss of the parental relationship, long established in the jurisprudential formant, continues to be the object of an expansive process that has progressively expanded the list of legitimized active to the request for compensation, arriving in recent times to include in the circle of protected subjects even simple boyfriends. This last landing of living law, by now acquired on the side of non-pecuniary prejudices, nevertheless continues to remain (at least in part) precluded in matters of merely patrimonial damages. It therefore seems appropriate to subject a different reconstructive trajectory to verification, which allows a full recognition in the system of the reparative instances referred to above.
La figura del danno da perdita del rapporto parentale, da lungo tempo sedimentata nel formante giurisprudenziale, continua ad essere oggetto di un processo espansivo che ha progressivamente ampliato il novero dei legittimati attivi alla domanda risarcitoria, giungendo in tempi recenti ad includere nella cerchia dei soggetti tutelati anche i semplici fidanzati. Tale ultimo approdo del diritto vivente, ormai acquisito sul versante dei pregiudizi non patrimoniali, continua tuttavia a rimanere (almeno in parte) precluso in materia di danni meramente patrimoniali. Sembra dunque opportuno sottoporre a verifica una diversa traiettoria ricostruttiva, che consenta un pieno riconoscimento nel sistema delle istanze riparatorie da ultimo richiamate.
