Despite the doubts raised by the formula «When the VTS is authorized to issue instructions to vessels, these instructions should be result-oriented only» (IMO Resolution A.857/1997, par. 2.2.3.4.), the decision-making primacy of the commander is confirmed by the correct interpretation of the rule. The VTS discipline is centered on the correctness of the information. The VTS must deliver continuous and accurate information. The commander relies on them. The figures of the Air Traffic Control operator and the VTS operator are also compared. The functions of the ATC and those of the VTS are intertwined, respectively, with the tasks of the pilot in command and the master of ship. Based on the orientation expressed by the Supreme Court (Criminal Court, Section IV, April 12, 1985, No. 5564 and Criminal Court, Section IV, December 10, 2010, No. 6820), the ATC operator is burdened by a «guarantee position» under Article 40, paragraph 2 of the Penal Code which provides that: «Failing to prevent an event which one has the obligation to prevent shall be equivalent to causing it». The doubt arises that the same guarantee position could burden the VTS operator. Ship captain and VTS operator perform different tasks. Their responsibilities are different. However, they converge, together and not separately, their efforts towards the safety of navigation.

L’Autore esamina i poteri del comandante in rapporto alle funzioni svolte dal Vessel Traffic Service. Particolare attenzione è riservata ai profili di responsabilità del comandante della nave e dell’operatore VTS in base alla vigente IMO Resolution A.857(20) del 1997. Nonostante i dubbi sollevati dalla formula secondo cui le «instruction» erogate dal VTS «should be result-oriented only» (IMO Resolution A.857/1997, par. 2.2.3.4.), il primato decisionale del comandante è confermato dalla corretta interpretazione della norma. La disciplina del VTS è imperniata sulla precisione delle «informazioni». Il VTS deve erogare «instruction» continue ed esatte. Su di esse fa affidamento il comandante, gravato da funzioni apicali per la sicurezza della nave. Sono inoltre messe a confronto le figure dell’air traffic control operator e del VTS operator. Le funzioni dell’ATC e quelle del VTS si intrecciano, rispettivamente, con i compiti del «pilot in command» e dal «master of ship». Sulla base dell’orientamento espresso dalla Cassazione (Cass. pen. 12 aprile 1985, n. 5564, e Cass. pen. 10 dicembre 2010, n. 6820), l’ATC operator è gravato da una posizione di garanzia ex art. 40, comma 2, c.p.
