To avoid the risk of contagion and contain the spread of the virus, the pandemic crisis has been managed with stay-at-home and lockdown orders. Emergency situa tions are not faced in the same way by everyone, and this depends on the means available. A lockdown in an unhealthy, small, inadequate home is not the best condition for dealing with a health crisis. In times like these, the right to housing proves to be even more fundamental as a subjective right and as a precondition for the enjoyment of other fundamental rights as health and education. In this paper, some reflections on the pandemic are accompanied by the normative analysis of the right to housing in Italy and abroad in order to highlight how fundamental it is especially in time of crisis.
