DE CIVITATIBUS EXPELLENDIS ET ULTIMO SUPPLICIO TRADENDIS IN C.1.5.5.1: DUE SANZIONI IN CONTRASTO?

Јустинијанова верзија једне конституције Теодосија II унета у C.1.5.5.1 озваничава као казне против Манихејаца, како прогонство, тако и ultimum supplicium. Привидна антиномија између две санкције могла би се разрешити ако се претпостави да је извршење друге условљено непоштовањем прве: ако би онај који је осуђен на прогонство био затечен на римском тлу био би убијен, као одјек, можда, веома старе казне стављања ван закона.

The Justinian version of a constitution by Theodosius II, accepted in C.1.5.5.1, establishes both exile and the ultimum supplicium as penalties against the Manicheans. The apparent antinomy between the two sanctions could be resolved if it is believed that the execution of the second was subject to failure to comply with the first: if the person condemned to exile had been found on Roman soil he would have been killed, punishment perhaps evoking the ancient sanction of sacredness.

La versione giustinianea di una costituzione di Teodosio II accolta in C.1.5.5.1 sancisce come pene contro i Manichei sia l’esilio che l’ultimum supplicium. L’apparente antinomia tra le due sanzioni potrebbe essere risolta se si ritiene che l’esecuzione della seconda fosse subordinata al mancato rispetto della prima: se il condannato all’esilio fosse stato sorpreso sul suolo romano sarebbe stato ucciso, ad evocazione, forse, dell’antichissima sanzione della sacertà.
