The essay traces the constitutional case-law on Article 19 St. lav., to check if, in the presence of the changed context (even prescriptive) in which the provision is called to work, new profiles of unconstitutionality can be identified, with particular reference to the compression of freedom protected by Article 39, co. 1 of the Constitution, as a result of the missed subscription of a corporate agreement by a representative union. The author points out particularly as in the new negotiation models can be found the possibility for the employer to weigh too much, through the stipulation of the corporate collective agreement, upon the freedom of unions, also meant as the freedom to negotiate, as a precise consequence of the current formulation of Article 19.
Il saggio ripercorre la giurisprudenza costituzionale sull’art. 19 St. lav., per verificare se, in presenza del mutato contesto (anche normativo) nel quale la disposizione è chiamata ad operare, siano individuabili nuovi profili di incostituzionalità, segnatamente con riferimento alla compressione della libertà garantita dall’art. 39, co. 1, Cost., per effetto della mancata sottoscrizione di un contratto aziendale da parte di un sindacato rappresentativo. L’autore evidenzia, in particolare, come nei nuovi modelli negoziali sia rinvenibile la possibilità per il datore di lavoro di incidere eccessivamente, attraverso la stipulazione del contratto collettivo aziendale, sulla libertà sindacale, intesa anche quale libertà di negoziare, proprio in conseguenza della formulazione vigente dell’art. 19.
