Imprese di informazione locale: la Corte afferma la legittimità dell’esclusione dai finanziamenti pubblici anche in caso di condanne non definitive

The article comments on sentence n. 248/2019 with which the Constitutional Court has stated the groundlessness of the question of constitutional legitimacy relating to a law of the Umbria region on public economic support to local information companies. This regional law had been challenged in relation to the non-exclusion from funding companies whose owners had been convicted, even if not definitively, for crimes against the public administration and for crimes against property committed with fraud. The article also considers the cases of the laws of the Autonomous Province of Trento and of the Abruzzo region which, among the requirements for the allocation of public residential housing, provide for the absence of definitive convictions against the applicant and the members of his family, in the ten years preceding the application, for unintentional crimes punished with imprisonment of not less than five years. With regard to these laws, several aspects of unconstitutionality are assumed.
